The World Intellectual Property Organization (WIPO) recently announced its ruling on the MagicMenLive.com domain name dispute, finding that Australian Magic Men Holdings Pty Ltd (hereinafter referred to as “Australian Company”) committed reverse domain hijacking and dismissing its complaint against American individual Myles Hass.

The case stemmed from August 2025, when Australian Company filed a complaint alleging that MagicMenLive.com was confusingly similar to its “MAGIC MEN” Australian trademark, registered in 2014, and that the defendant had registered the domain name in bad faith. Hass alleged that Hass engaged in unfair use of the domain name and that the website had been inactive for a long time.
However, Hass countered by stating that he had been performing in the United States under the “Magic Men Live” name since 2012, predating the Australian Company’s trademark registration, and had registered trademarks in the United States, Canada, and the United Kingdom. He also registered the disputed domain name in 2015 for brand promotion and provided performance records, brochures, and other evidence.
After review, the arbitration experts determined that Hass preceded the Australian company in both trademark registration and commercial use. With their respective businesses located in the US and Australia, there was no likelihood of competition or confusion, and that Hass’s registration and use of the domain name was not malicious. More importantly, the experts found that the Australian company had privately contacted Hass to purchase the domain name and social media account, knowing of the other party’s rights but concealing them in its complaint, thus violating the UDRP’s principle of good faith.
The WIPO ruling ultimately dismissed all of the Australian company’s claims, affirming Hass’s legitimate rights to MagicMenLive.com and finding that the Australian company had engaged in reverse domain hijacking and abused the UDRP process.
