Recently, the World Intellectual Property Organization (WIPO) ruled in favor of Insurify in its domain name dispute with insurafy.com, dismissing all of the plaintiff’s claims and confirming that the domain name remains the property of the original registrant. The core dispute stemmed from a single letter difference between the domain name and the brand name, but the outcome was ultimately reversed due to crucial chronological evidence.

Insurify, an online insurance comparison engine provider, owns the insurify.com domain name and related trademarks. Insurify argued that insurafy.com replaced the second “i” in its trademark with an “a,” constituting a typical misspelling variant. Furthermore, Insurify also provides insurance services, suggesting confusing similarity and deceptive intent, and therefore initiated the UDRP lawsuit.
The panel of experts, after reviewing the case, acknowledged that insurafy.com is highly similar to the INSURIFY trademark and is indeed a misspelling variant. However, the key basis for the ruling focused on the chronological order: evidence showed that the insurafy.com domain was registered in July 2015, while Insurify first used the trademark in January 2016. Furthermore, Insurify initially operated under the name Ensurify, Inc., and used other domains such as insurify.io before integrating them into insurafy.com.
Furthermore, the panel pointed out that numerous similar domains with the structure “insure/insur” + “ify” exist in the market. “Insurafy” is not an exclusive combination for Insurify, and there was no evidence that the domain registrant was aware of the company’s plans when registering in 2015. Even if there was subsequent overlap in services provided by both parties, it could not be determined that the registrant engaged in targeted malicious registration.
Ultimately, based on the core principles of “priority of registration time” and “no malicious evidence,” the WIPO panel rejected Insurify’s complaint and upheld the original ownership of the insurafy.com domain.
