Legal Dispute Over .cz Domain ADR System Escalates

The Czech domain registry CZ.NIC is facing legal challenges regarding its Alternative Dispute Resolution (ADR) system for out-of-court domain disputes.

The conflict began when AliaWeb, a CZ.NIC member, filed a lawsuit seeking to invalidate the introduction of the ADR process, arguing that it was not compliant with Czech law. While the Municipal Court in Prague upheld the validity of ADR, the High Court ruled that CZ.NIC’s board did not have the authority to make such a decision independently.

In response, CZ.NIC has appealed to the Supreme Court, emphasizing that the ruling could have significant implications for the Domain Name System in the Czech Republic. The registry aims to establish legal clarity and certainty for both domain owners and rights holders.

Parties currently involved in an ADR process concerning a .cz domain should evaluate whether they might be negatively affected if the procedure is deemed invalid. The Supreme Court’s ruling will be crucial in determining the future of dispute resolution for .cz domains.
